Swimming Pool Legislation

In NSW, swimming pool safety is governed by the Swimming Pools Act 1992, the Swimming Pools Regulation 2018, and the Australian Standard AS 1926 (various editions). Different rules apply depending on when your pool was built:

Applicable Standards by Construction Date

  • Before 30 August 2008: AS 1926-1986 applies.

  • Between 1 September 2008 and 30 April 2013: AS 1926.1-2007 applies.

  • After 1 May 2013: AS 1926.1-2012 applies.
    If your pool barrier has been modified or altered, it must comply with the current standards, and any earlier exemptions no longer apply.

What Owners Must Know

  1. Obligation to Register & Certify

    • All swimming pools must be registered via the NSW Swimming Pool Register.

    • If you're selling or leasing a property with a pool, you're required to provide:

      • A Certificate of Compliance, or

      • A Certificate of Non-Compliance, or

      • A valid Occupation Certificate.

  2. Exemptions

    • Certain small, very large, or waterfront properties may qualify for limited exemptions—review your eligibility carefully.

  3. Council's Role

    • Council is responsible for:

      • Being notified of all pools within the jurisdiction.

      • Promoting awareness of the legislation.

      • Handling complaints and ensuring compliance. NSW Legislation

  4. Updating Compliance Requirements

    • Older pools that were previously compliant may still be acceptable—but once altered, they must meet current standards.
